As for your later statement, if I have the resources to even attempt to track you through Tor, I definitely have the resources to know that you're using Tor without you explicitly saying so. It's blatantly obvious that someone is using Tor when a bunch of encrypted 512-byte packets are getting sent back and forth.
There have been a few cases of someone being arrested for doing something stupid while using tor, like if a threatening email was received and they suspect it was sent from a certain place, say a university, they can see who was using Tor at that time. This problem is mitigated by always using Tor, not just when you're being stupid.
