SO, the Supreme Court has once again decided to vote YES on a bill that's worded so poorly and vaguely it could completely circumvent our Bill of Rights.

TL;DR if the police smell marijuana at your house and hear what sounds like the destruction of evidence. (eg. flushing a toilet) they have the right to enter and search your home without a warrant. They can break down the door, toss everything to shit, and leave, legally.






I hear Canada's really nice this time of year.

Not many people have to worry about a cop randomly showing up at your house and smelling your marijuana. Unless you're throwing a giant ass party, well then you should be prepared anyway.

Plus, I thought the smell of marijuana has always been used as probable cause. At least for searching cars, maybe not homes?

That's an amazing infographic, and I think everyone who doesn't already know this stuff ought to give this a read through.

What's changed, primarily, is that where the infographic says the police can search your home if you open the door and they smell weed, the police can now break down your door and search the place if they smell it and hear what sounds like the destruction of evidence.

Yep. You have the constitutional right to not open the door for a police officer, so before, our hypothetical officer would have had to respect your decision and come back with a warrant, but now he needs only to hear a noise that could be the destruction of evidence to break down your door.
