It isn't illegal to spend money you receive in exchange for a service( which is what you're doing by giving donators benefits ) in whatever way you please. A gray area is when you ask for donations on a site linked to on your server, but never specify what the donation will go toward. Downright illegal would be saying you'll use the donations exclusively for the servers and not doing so.

Obviously some of this changes if, for some reason, your server is owned by an incorporated entity, but I doubt anyone will do that.

Which are normally given as a 'Thank you' for donating. Unless you want to deal with tax etc. (just my previous experience)
