It's certainly possible, but you do need access to the handset to Install monitoring software.
Don't believe all the sites floating around the net that claim that you can Install the software remotely. It cannot be done. In terms of whether It's legal, It depends on the circumstances and reason. For example, If you wish to monitor the activity of your children for their "safety", that should be fine. If you have "permission" to Install the monitoring software and spy thereafter, that's fine too. If you're Invading one's privacy and obtaining confidential and sensitive Information without permission or knowledge from the other party, you may find yourself In a bit of trouble.
Different countries have different regulations, so I'm simply generalizing my post.
