I am not familiar with the UK or EU laws, but I think in US an individual is protected from being forced to disclose encryption keys via self-incrimination law.

He's encrypted files for a reason- obviously they contain sensitive data and credentials.

Depending on the exact nature of the data, I highly doubt he would hand over the keys.

If a device is not encrypted, but as a password lock they can force you to give over the password or they'll just break into it themselves. They can't legally force you to hand anything over unless it's physical evidence. So no, you were wrong. They can't force you to give them a password, unless you're retarded and have it written down in some unhidden place.

Nope. They can't legally force you to "hand over" anything that is stored mentally. That's why you should A. never write down passwords or B. write down passwords but keep them very well hidden.

The best thing to do for long and complex (near impossible to memorize) passwords is storing them on an encrypted drive of some sort and hide it. That way, in the case that they do find it, it will still be encrypted and they can't force you to hand over an encryption key.

Regardless of all of this, you have the right to remain silent. That's why America is great and that's why the best thing to do if you're confronted by any authorities is keeping your mouth shut, literally.

I do agree with this.

That said, the question remains, does the police have enough physical evidence (of the hacktivist) that warrants the encryption keys to be handed over, thus the keys are deemed as part of their physical evidence?

This, especially the last part. As bad as you'd want to, don't say anything because anything and everything, well, will be used against you. No matter what they may say, they are trying to deceive you. Don't say anything.
